By using our site and/or making a purchase, you agree to be bound by these Terms and Conditions, as well as our additional policies.

2. Use of the Website

By using this site, you represent and agree that:

  • You are at least the age of majority in your state of residence in the United States.
  • You will not use our products for any illegal or unauthorized purpose.
  • You will not violate any applicable laws in your jurisdiction.
  • User Accounts: If you create an account, you are responsible for maintaining the confidentiality of your password.
  • Privacy: The use of your personal information is governed by our Privacy Policy.

We reserve the right to refuse service to anyone for any reason at any time.

3. Products, Availability, and Pricing

All products are subject to availability. We reserve the right to:

  • Limit quantities of any product or discontinue sales to specific regions.
  • Modify prices or discontinue products without prior notice.
  • Pricing Errors: In the event of a typographical error in pricing, we reserve the right to cancel the order and refund the amount paid, even if the order has already been confirmed.

4. Shipping and Perishable Logistics

Due to the nature of our food products, the following shipping rules apply:

  • We ship throughout the entire United States territory.
  • Estimated processing and dispatch time: 1 to 3 business days after payment confirmation. Delivery times may vary depending on destination and carrier.
  • Mandatory Expedited Methods: Any order containing refrigerated products must be shipped via expedited methods (Overnight or 2-Day Air). Standard ground shipping is not available for these items.
  • Dispatch Days for Refrigerated Products: To protect the cold chain, orders with refrigerated products are shipped only from Monday to Thursday. Orders placed from Friday to Sunday will be processed starting the following Monday.
  • Shipping Addresses: We do not ship to P.O. Boxes.
  • Delivery Responsibility: It is the customer’s responsibility to receive the package on the delivery day. Latinfood® is not responsible for products damaged due to being left unattended after delivery confirmation by the carrier.
  • Latinfoodus® is not responsible for delays caused by third parties (carriers, weather, logistical events, etc.).

5. Refund and Claims Policy

For biosecurity reasons and FDA regulations, we do not accept physical returns of food products. Refunds or replacements will be issued under the following conditions:

  • Reporting Timeframe: Any issue with refrigerated products must be reported within the first 24 hours after delivery. For non-perishable products, the timeframe is 48 hours.
  • Evidence: Clear photographs of the affected product, packaging, and cooling materials will be required.
  • Exceptions: Claims will not be accepted for change of mind, personal preferences, or customer negligence in receiving the package.

6. Health and Food Disclaimer

  • Nutritional Information: While we strive for accuracy, manufacturers may change ingredients. We recommend always reading the physical product label before consumption.
  • Allergies: The customer is solely responsible for verifying ingredients to avoid allergic reactions.
  • FDA: Statements about the products have not been evaluated by the FDA and are not intended to diagnose, treat, or cure diseases.

7. Dispute Resolution and Governing Law

These terms are governed by the laws of the State of New York. Any dispute related to this site shall be resolved through binding arbitration. By accepting these terms, you expressly waive your right to participate in class action lawsuits (Class Action Waiver).

8. Risk of Loss

The risk of loss and title for purchased items pass to the customer at the moment we deliver the package to the carrier (FOB Shipping Point).

9. Intellectual Property

All content on the site (logos, images, text, design) is the property of Latinfood® or its suppliers and is protected by intellectual property laws.

10. Modifications

We reserve the right to update these terms at any time. Changes will take effect immediately upon being posted on the website.

Al utilizar este sitio, declaras y aceptas lo siguiente:

3. Productos, Disponibilidad y Precios

Todos nuestros productos están sujetos a disponibilidad. Nos reservamos el derecho de:

  • Errores de Precio: En caso de un error tipográfico en el precio, nos reservamos el derecho de cancelar el pedido y reembolsar el monto pagado, incluso si el pedido ya fue confirmado.

4. Envíos y Logística de Perecederos

Debido a la naturaleza de nuestros productos alimenticios, se aplican las siguientes reglas de envío:


  • Realizamos envíos a todo el territorio de Estados Unidos.
  • Tiempo estimado de procesamiento y despacho: 1 a 3 días hábiles después de confirmado el pago. Los tiempos de entrega pueden variar dependiendo del destino y del transportista.
  • Métodos Acelerados Obligatorios: Todo pedido que contenga productos refrigerados debe ser enviado mediante métodos acelerados (Overnight o 2-Day Air). El sistema no permitirá métodos terrestres estándar (Ground) para estos artículos.
  • Días de Despacho productos refrigerados: Para proteger la cadena de frío, los pedidos con productos refrigerados se despachan únicamente de lunes a jueves. Pedidos realizados de viernes a domingo se procesarán a partir del lunes siguiente.
  • Direcciones de Envío: No realizamos envíos a apartados postales (P.O. Boxes).
  • Responsabilidad de Recepción: Es obligación del cliente recibir el paquete el día de la entrega. Latinfood®  no se hace responsable por productos dañados debido a que permanecieron a la intemperie después de la confirmación de entrega del transportista.
  • Latinfoodus® no se hace responsable por retrasos ocasionados por terceros (transportistas, clima, eventos logísticos, etc.). 

5. Política de Reembolsos y Reclamaciones

Por razones de bioseguridad y regulaciones de la FDA, no aceptamos devoluciones físicas de productos alimenticios. Se aplicarán reembolsos o reemplazos bajo estas condiciones:

  • Plazo de Reporte: Cualquier inconveniente con productos refrigerados debe reportarse dentro de las primeras 24 horas tras la entrega. Para productos no perecederos, el plazo es de 48 horas.
  • Evidencia: Se solicitarán fotografías claras del producto afectado, el empaque y los materiales refrigerantes.
  • Excepciones: No se aceptan reclamos por cambio de opinión, preferencias personales o negligencia del cliente en la recepción del paquete.

6. Descargo de Responsabilidad de Salud y Alimentos

  • Información Nutricional: Aunque nos esforzamos por la precisión, los fabricantes pueden cambiar ingredientes. Recomendamos leer siempre la etiqueta física del producto antes de consumirlo.
  • Alergias: El cliente es el único responsable de verificar los ingredientes para evitar reacciones alérgicas.
  • FDA: Las declaraciones sobre los productos no han sido evaluadas por la FDA y no pretenden diagnosticar, tratar o curar enfermedades.

7. Resolución de Disputas y Ley Aplicable

Estos términos se rigen por las leyes del estado de New York. Cualquier disputa relacionada con este sitio se resolverá mediante arbitraje vinculante. Al aceptar estos términos, renuncias expresamente a tu derecho a participar en demandas colectivas (Class Action Waiver).

8. Riesgo de Pérdida

El riesgo de pérdida y la titularidad de los artículos comprados pasan a ser responsabilidad del cliente en el momento en que entregamos el paquete al transportista (FOB Shipping Point).
